California Proposal Targets Driver Privacy For Cheaper Insurance Rates

A controversial legislative proposal in California that would allow insurance companies to monitor motorists’ driving habits in exchange for potential premium discounts is drawing fierce opposition. The draft law faces a wall of resistance from the state’s Department of Insurance, alongside consumer rights and privacy advocates, as it threatens to upend decades of consumer protection laws.

Assembly Bill 311 seeks to permit insurers to utilise telematics—advanced tracking technology installed in vehicles or accessed via smartphone apps. This software transmits real-time data, including precise geographical location, speed, braking force, and cornering habits. Currently, California stands alone as the only US state that completely bans insurance providers from using such tracking metrics to determine premiums. Under long-established state regulations, firms must prioritise a driver’s safety record, total miles driven, and overall driving experience.

Supporters argue that the legislation would actively incentivise safer driving behavior, reducing road casualties. During a recent emotional hearing before the Senate Standing Committee on Insurance, proponents shared heartbreaking accounts of losing family members to distracted or reckless drivers. The bill’s author, Assemblymember Tina McKinnor, a Democrat from Inglewood, framed the technology as a vital tool to secure safer streets, noting she had lost three personal friends to vehicular accidents in recent years. Road-safety coalitions, including the non-profit group Safer Streets for Everyone, co-sponsored the bill, pointing to industry-backed studies that suggest financial rewards encourage better behind-the-wheel habits.

However, regulators and consumer watchdogs remain deeply sceptical. The California Department of Insurance has formally opposed the bill, declaring it fundamentally incompatible with Proposition 103—a landmark law approved by voters in 1988 to protect consumers from arbitrary rate hikes. Josephine Figueroa, Deputy Insurance Commissioner, warned that the proposal creates dangerous liability loopholes and effectively shifts regulatory oversight to unregulated, third-party data vendors.

State officials also highlighted evidence from Maryland, where data showed that tracking does not guarantee lower bills: only 31 per cent of monitored drivers saw premium reductions, whilst 24 per cent suffered rate increases. Critics additionally worry that algorithmic scoring could introduce systemic bias, disproportionately penalising low-income, Black, and Latino motorists based on the neighbourhoods where they live and work. With car insurance legally mandated across the state, civil liberties groups argue that citizens should not be forced to surrender their constitutional right to privacy just to keep a mandatory product affordable.
