President Shahabuddin Resigns, Speaker Assumes Constitutional Duties

Bangladesh President Mohammed Shahabuddin has resigned from office, bringing an early end to his tenure as the country’s 22nd President and triggering the constitutional process for the appointment of a successor. Following the submission and acceptance of his resignation, Speaker of the Jatiya Sangsad, Hafiz Uddin Ahmed, has called a press conference at the National Parliament Building, scheduled for 5:00 pm, where further details regarding the transition are expected to be announced.

With the office of the President now vacant, Bangladesh’s Constitution requires the Speaker of Parliament to assume the responsibilities of the Presidency until a new Head of State is elected and formally takes office. The arrangement is designed to ensure continuity in the country’s constitutional and administrative functions during the transition.

The resignation process is governed by Article 50(3) of the Constitution, which states that the President may resign by submitting a signed letter addressed to the Speaker. Article 54 further provides that if the office of the President becomes vacant, or if the President is unable to perform official duties because of absence, illness, or any other reason, the Speaker shall discharge the functions of the President until a newly elected President assumes office.

The Constitution also sets a clear timeline for filling the vacancy. Under Article 123(2), a presidential election must be held within 90 days if the office becomes vacant due to resignation, death, or removal. According to Article 48(1), the President is elected by the members of Parliament rather than through a direct public vote.

As the ruling Bangladesh Nationalist Party (BNP) currently holds a parliamentary majority, its nominated candidate is widely expected to secure the presidency. Discussions over the party’s potential nominee have reportedly been taking place among senior BNP leaders over the past several days, although no official announcement has yet been made.

Earlier on Friday, Speaker Hafiz Uddin Ahmed returned to Dhaka from Bangkok, Thailand, where he had travelled on 19 July for medical treatment. His return came two days earlier than originally scheduled. According to his previous itinerary, he had been expected to return on Sunday.

Speaking to journalists at Hazrat Shahjalal International Airport shortly after his arrival, the Speaker initially said he was unaware of any imminent presidential resignation, noting that he had been outside the country. He also explained the constitutional procedure, stating that if the President resigned, the resignation letter would be submitted to the Speaker, who would then perform the President’s duties until Parliament elected a new Head of State within the constitutionally mandated 90-day period.

Speculation surrounding President Shahabuddin’s future had intensified over recent days. Sources familiar with the matter had indicated that he was mentally prepared to step down. A source also claimed that during a meeting with senior Bangabhaban officials on Thursday, the President had discussed preparations for his departure, although no official confirmation was issued at the time.

Mohammed Shahabuddin assumed office on 24 April 2023 during the Awami League administration, beginning a five-year term that was due to expire in April 2028. His resignation, however, comes nearly two years before the scheduled completion of that term.

Debate over Shahabuddin’s continuation as President had persisted since the July 2024 mass uprising that resulted in the fall of the Sheikh Hasina government. The discussion became even more prominent after the BNP secured a parliamentary majority in the 13th Jatiya Sangsad election and formed the government. His resignation now marks a significant constitutional transition, with the process of electing Bangladesh’s next President set to begin under the provisions of the Constitution.
