Baul musician Abul Sarkar has been granted six months’ interim bail by the High Court in Bangladesh in a case involving allegations of “religious defamation and offensive remarks,” marking a significant development in a case that has drawn considerable public and legal attention.
The order was delivered on Sunday by a High Court bench comprising Md Atowar Rahman and Md Sagir Hossain following a hearing on Sarkar’s bail petition. The court also issued a rule alongside the interim bail, questioning the legality and grounds of the charges brought against the folk singer.
According to defence counsel Gazi Kamrul Islam Sajal, the allegations under religious defamation provisions lacked sufficient legal substance. He further stated that, provided there are no additional pending cases against Sarkar, there would be no legal barrier to his release following the High Court’s order.
State representation in the hearing was led by Deputy Attorney General Sultana Akter Ruby, who opposed the bail plea during proceedings.
Background of the Case
The case stems from an incident during a folk music performance at a religious fair in Ghior upazila of Manikganj district on 4 November. During a palagan (traditional lyrical debate performance) at the Jabra area’s Khala Pagli fair, allegations emerged that Abul Sarkar made remarks deemed offensive to religious sentiments.
A video clip of the performance quickly circulated on social media, triggering widespread criticism and public debate. The controversy escalated further, ultimately leading law enforcement agencies to take action.
On 19 November, Sarkar was detained by a team of Manikganj Detective Branch police from a musical gathering in Madaripur. He was later transferred to the district DB office the following morning.
Subsequently, the imam of Ghior Bazar Mosque, Mufti Md Abdullah, filed a formal case at Ghior Police Station, accusing Sarkar of insulting religious beliefs and making provocative comments intended to offend religious sentiment.
Following his arrest, Sarkar was produced before the Senior Judicial Magistrate Court in Manikganj on 20 November, which ordered his detention in jail custody. After remaining in custody for several months, he has now been granted interim bail by the High Court.
