Ireland’s media regulator has announced an official investigation into Elon Musk’s social media platform, X, amid concerns that it may have breached European Union regulations by failing to provide users with a clear avenue to appeal moderation decisions. According to the statement, X may not be offering users a sufficiently accessible or user-friendly mechanism to challenge content moderation outcomes, as required under EU law. The regulator emphasised that the Digital Services Act (DSA) — which governs online platforms across the European Union — stipulates that users must have the right to contest moderation decisions in a transparent and straightforward manner.
Under the DSA, X is designated as a “very large online platform,” meaning it falls under enhanced regulatory oversight due to its size and influence. Platforms of this scale are required to meet stricter compliance standards, including transparency in content moderation and the provision of effective complaint systems.
Brussels had already launched its own investigation into X at the end of 2023, focusing primarily on the dissemination of misinformation on the platform. However, under the DSA framework, national regulators in the countries where a company’s European headquarters are located hold responsibility for ensuring compliance with specific provisions of the legislation. In X’s case, this responsibility falls to Ireland.
John Evans, Ireland’s digital services commissioner, said: “This investigation will assess whether X has properly informed users of their rights to contest decisions it makes. We will not hesitate to intervene and, where appropriate, take enforcement action to protect the safety of users in Ireland and across the European Union.”
This investigation is significant, as it represents the first instance of the Irish regulator invoking powers under the DSA. If X is found to be non-compliant, it could face penalties of up to six percent of its global revenue — a potentially substantial financial sanction given the platform’s international reach.
