Legal Notice Demands Withdrawal of Arrest Orders

A legal notice has been issued to Mohammad Shahjahan, the Deputy Inspector General (DIG) of Rajshahi Range, by the Law and Mediation Centre over his directive to arrest influential leaders and activists of a banned and suspended fascist organisation immediately after their release on bail in other cases. The notice formally demands the withdrawal of this controversial instruction.

The notice was delivered on Monday by the Centre’s lawyers, Syeda Nasrin and Shaheenuzzaman. It calls upon the DIG to revoke the directive within seven days and take necessary remedial action. The notice further warns that failure to comply could result in a writ petition being filed with the High Court.

According to the legal notice, the directive in question was issued on 24 February. It specified that leaders and activists of the banned organisation who are capable of strengthening, restructuring, and mobilising the group after release on bail should immediately face arrest in other pending cases. Conversely, those deemed incapable of undertaking such active roles were exempted from immediate post-bail arrest. The order was addressed to the Superintendents of Police (SPs) of the districts under Rajshahi Range: Rajshahi, Chapainawabganj, Naogaon, Natore, Pabna, Sirajganj, Bogura, and Joypurhat.

A summary of the directive and the notice is presented below:

Abu Ahmed Faizul Kabir, Senior Coordinator of the Law and Mediation Centre, confirmed that the notice was sent via registered post to ensure official acknowledgment. He stated, “Through this legal notice, we have clearly communicated our demand for immediate revocation of the DIG’s directive and expect necessary corrective measures to be taken without delay.”

DIG Mohammad Shahjahan declined to comment on the notice. He said, “I do not wish to make any statement on this matter. I will act in accordance with the law regarding any steps required.” When asked whether he had received the notice, he offered no response.

The legal intervention has sparked debate among local human rights observers and political analysts, who argue that the directive could undermine bail protections and raise constitutional concerns regarding the treatment of political activists post-release. The issue is expected to attract further legal scrutiny in the coming days.
